The agreement

Terms of service

Last updated 22 September 2026

Plain English, because you should be able to read this once and know where you stand. If anything here contradicts something a page on this site says, tell me and I will fix it.

Who you are dealing with

Clymer AI is operated by Eric Clymer, a sole practitioner based in Austin, Texas, taking on businesses anywhere in the United States. There is no company behind me and no account manager. When these terms say "I", that is who it means. When they say "you", that means the business buying the work.

What you are buying

An AI Operating System: a set of systems that answer your customers across the channels they use, built against your own business and handed over for you to own and change.

The exact scope is agreed in writing before any work begins. The scope document is what governs the work. A price shown to you by the assistant on this site is my genuine estimate based on what you told it, not a binding quote – the written scope is.

The deposit

Paying the deposit does two things. It reserves your place – I take on four clients at a time – and it credits in full against the total.

It does not by itself start the work, and it does not lock you in. The balance is due as set out in your written scope, and no balance is ever payable before you have agreed that scope. Refunds are covered in the refund policy, which forms part of these terms.

Founding customers

The first five businesses to buy are founding customers. A founding customer gets $1,000 off the AI Operating System, or $1,000 off a local install. The founding price is the one shown on the price card, and it is written into your scope.

In return, once your systems have run long enough to have real numbers, I write up what happened – your business name, what was built and what it did – and publish it. You read it before it is published, and I correct anything that is wrong. If you would rather not be written up, tell me before the scope is agreed and the standard price applies.

What is included, and what is not

Included: the systems described in your scope, a website wired into the same knowledge where that is part of it, training that is recorded, a one-page sheet per system, and the plain-English controls to change how it answers.

Not included, and I will say so rather than quietly take the work: marketing strategy or creative, content, social media, ad buying, SEO beyond the site being technically sound, and sales coaching.

What you own

You own all of it. Your data, your accounts, your logins, the configuration, and the knowledge the system builds up. There is no proprietary layer that stops working if we part ways, and nothing is held back as leverage.

If you stop working with me, everything stays with you in formats you can open without me. That is a term of this agreement, not a favour.

Your data

I will only use your data to build and run your systems. Your records are never used to train any model.

Before anything is built we agree where your data lives. Running locally means it stays on hardware in your building. Running on frontier models means it is processed by a third-party model provider under their terms, which I will show you.

Nothing here is a HIPAA business associate agreement, and nothing on this site makes you HIPAA compliant. If you handle protected health information, say so before you buy. We will work out what is and is not covered, and if a BAA is needed it has to be agreed separately and in writing.

What the AI can and cannot do

These systems generate language. They can be wrong, and on a long enough timeline they will be.

  • You decide what the system is allowed to send to a customer without your approval. That line is set in your scope and you can move it at any time.
  • Anything that quotes a price, promises a date or touches money waits for your approval unless you explicitly configure it otherwise.
  • Every system has a manual fallback your staff already know, because it is how you work today.
  • You are responsible for what your system says to your customers, in the same way you are responsible for what an employee says. I will build the guardrails, keep a full written record of every message, and fix problems quickly. I cannot guarantee the system will never make a mistake, and I do not accept liability for the content of messages it sends within the limits you configured.

Your side of it

To build this I need access to the material the system learns from and to the accounts it has to work with. Delays in getting me those delay the work. You are responsible for having the right to share whatever you give me, and for telling me if any of it is regulated or confidential in a way I should know about.

Support afterwards

There is no retainer, no minimum and no notice period. After handover you can text or call me, and anything you want changed is a conversation. That is a commitment to be reachable, not a service level agreement – I do not guarantee response times, and I am one person.

Limits

I will do this work carefully and to a professional standard. Beyond that, and to the extent the law allows, my total liability to you for anything connected with this work is limited to what you have actually paid me for it.

I am not liable for indirect or consequential losses – lost profits, lost business, lost data where you had a reasonable means of backing it up, or losses caused by a third-party service changing or going down. Nothing here limits liability that cannot legally be limited.

Ending it

Either of us can end this. If you end it, the refund policy sets out what comes back. If I end it – because I cannot do the job well, or the work turns out to be something I said I do not do – I will return anything you have paid for work I have not done, hand over what exists, and say plainly why.

Changes to these terms

If I change these terms, the version that applies to you is the one in force on the day you paid. I will not apply a later change retroactively to work you have already bought.

Which law applies

These terms are governed by the laws of the State of Texas, and any dispute belongs in the courts of Travis County, Texas. Before anyone goes near a court, contact me – most things are a phone call.
